Laura Prepon and estranged husband Ben Foster have made new accusations against each other in the midst of their ongoing divorce.
The 45-year-old actress said in a court document filed on Wednesday in Nashville that Foster, 44, is ‘guilty of habitual drunkenness.’
It came it response to his amended divorce peтιтion, filed on Tuesday, in which he cited ‘inappropriate marital conduct’ as another reason for the breakdown of the marriage. He’d initially claimed it was due to ‘irreconcilable differences.’
In official paperwork obtained by People, Foster additionally accused his wife of ‘cruel and inhuman treatment,’ which Laura has denied, demanding ‘strict proof’ of the claims. She also leveled the same accusation against him.
The couple’s separation date is listed as September 9, 2024.

Foster stated that the aforementioned ‘cruel and inhuman treatment’ ‘renders further cohabitation [with Prepon] unsafe and improper.’
He has also requested joint custody of their two children — daughter Ella, seven, and a five-year-old son whose name has not been shared publicly — adding that both parents ‘are fit and proper’ caregivers.

However, Prepon ‘denies that both parties are fit and proper parents to be awarded the joint care, custody, and control of the parties’ minor children and demands strict proof thereof.’
The Orange Is The New Black star also wishes to be the primary residential parent of the kids, claiming, ‘This is in the children’s best interests.’
It comes after a temporary custody deal put in place in January included restrictions on how much alcohol each party is allowed to drink around their children.
The order, shard by InTouch at the time, read: ‘Neither party shall consume alcohol to the point of intoxication while around the minor children during his or her parenting time.’
They also agreed that ‘if either party has employment that requires him or her to travel out of state during his or her parenting time, then that party will provide reasonable notice to the other party.’
The former couple also agreed to restraining employees from ‘speaking derogatorily about the other party to or in the presence of the minor children.’

Prepon claimed in December that Foster has a ‘longstanding history of alcohol abuse’ as she responded to his request for a temporary custody schedule.
She asked that Foster be ordered not to drink 12 hours before or during time with the children and also alleged he often ‘day drinks.’
Foster’s lawyer, Rose Palermo denied the claims, telling the NY Post last year: ‘Laura Prepon’s filing is the definition of falsehood and a disturbing fiction. Her actions will continue to harm the children who have always been Ben’s first priority.’
Ben filed for divorce on November 12, 2024 after six years of marriage.
