Spencer Pratt and his wife Heidi Montag have filed a lawsuit against the city of Los Angeles and the Department of Water and Power.

Pratt, 41, and Montag, 38, lost their $2.5 million Pacific Palisades home to the devastating Los Angeles fires on January 8th.

The couple have now joined other homeowners in suing the city over the damage to their properties, as per The Hollywood Reporter. 

Their lawsuit, filed in California’s Superior Court in Los Angeles County on Tuesday, accuses the Los Angeles Department of Water and Power of ‘failing to maintain an adequate water supply system to fight the blazes.’

It further states that the blaze was ‘an inescapable and unavoidable consequence’ due to how the city and LADWP allegedly managed the area’s water supply. 

It points to ‘delays in in repairing the Santa Ynez Reservoir, leaving the mᴀssive water storage complex in the heart of the Palisades empty for nearly a year.’

20 other property owners have joined the lawsuit as well, including Pratt’s mother Janet Pratt. His sister, Stephanie Pratt, previously confirmed their parents’ home was also destroyed in the Palisades fire, just hours after Spencer and Heidi’s home. 

‘With the Santa Ynez Reservoir effectively out of commission, hydrants in Pacific Palisades failed after three tanks each holding one million gallons of water went dry within a span of 12 hours,’ the lawsuit alleges.

The lawsuit blames the LA Dept of Water and Power of emptying the reservoir before the fire, ‘allegedly to seek contractor bids rather than use in-house personnel to repair it.’

‘This stated public purpose was far outweighed by the substantial risk posed to Pacific Palisades by wildfires,’ the lawsuit states. 

‘The degree of damage that resulted from the Palisades Fire far outweighed any benefit that could have been realized by outsourcing and delaying repairs.’

The lawsuit also ‘alleges inverse condemnation, which allows property owners to seek compensation over damages caused by public use. It seeks unspecified damages.’ 

Their damages include property repair costs, loss of property enjoyment, and lost wages.

Earlier this month, Spencer revealed his plans to sue the State of California after his home was tragically burnt down.

The former reality star announced that he intends on filing a lawsuit against California due to their alleged negligence that resulted in the loss of his residence.

While speaking to blogger, Perez Hilton, the father-of-two recalled desperately trying to get help from Los Angeles Fire Department as he watched his property go up in flames.

‘They never came. The gate was still locked,’ he claimed. ‘They never came. I watched from my security cameras until our house burned down. There were no fire trucks.’

As his home burned down, Pratt insisted that he called 911 and informed them that if they sent ‘one fire truck’ to his street that they ‘could stop [the fire from] coming down the whole freaking area.’

In response to his suggestion to bring in a truck, he said he was told that the fire department didn’t ‘have the ᴀssets.’

The couple’s home was flattened to the ground after the raging fire took over the LA landscape and wreaked fiery havoc, and pH๏τos obtained by DailyMail.com showed the severity of the devastation.

The only parts of the home still standing were the charred entry gate and the front portion of the home’s stucco perimeter wall. Large piles of debris were seen throughout the property as well as burnt foliage that once decorated the home’s front yard.

His decision to sue comes amid widespread backlash against Los Angeles Mayor Karen Bᴀss’ lack of preparation and rapid response to the wildfires.

Meanwhile, President Donald Trump has blamed Gavin Newsom, the Governor of California, for the killer wildfires that have ravaged the state.

Like a lot of California homeowners, The Hills alums’ policy was dropped by their insurance company last year.

‘We were house poor, as they call it,’ Heidi explained in a recent interview on Good Morning America.

‘Like, we have a house and everything else is a hustle, is a grind. So yeah, we’re definitely counting every dollar that we make because we’re working really hard. We take one trip a year.’

Montag and Pratt have been posting videos on social media about their ordeal, and they managed to garner enough fan support to get her 2010 album Superficial to the top of the iTunes chart in the US last Saturday.

‘The fan support has been such a light in such a darkness for us, and it’s life changing,’ the Colorado-born blonde shared.

Celebrities publicly supporting Heidi’s record include Paris Hilton, Emily Ratajkowski, Julia Fox, Howie Mandel, Flavor Flav, Diplo, Dillon Francis, Gabby Thomas, Alix Earle, Nick Viall, and Tana Mongeau.

The married couple of 16 years are proud parents of seven-year-old son Gunner and two-year-old son Ryker.

Several wildfires have recently impacted the Los Angeles area.

The Eaton Fire that scorched 14,021 acres east of Los Angeles was 91 percent contained, while the larger Palisades Fire, which has consumed 23,448 acres on the west side of Los Angeles, stood at 68 percent contained on Wednesday.

Since the two fires broke out on January 7, they have burned an area nearly the size of Washington, D.C., killed 28 people and damaged or destroyed nearly 16,000 structures, Cal Fire said.

Private forecaster AccuWeather projects damage and economic losses at more than $250 billion.
