Tony Bennett’s daughters Antonia and Johanna are accusing their brother Danny of ‘mismanaging’ their late father’s trust — less than two years after his death at 96.

Back in June, Antonia and Johanna named Danny as well as their brother Daegal ‘Dae’ Bennett and Tony’s widow Susan Benedetto in a lawsuit regarding the late singer’s estate and unaccounted ᴀssets.

It was previously revealed that Antonia, Johanna and Daegal are beneficiaries of The Tony Bennett 1994 Family Trust while Danny, who also worked as his late father’s business manager, oversees the family trust in the role of trustee.

In their June legal filing, the sisters asked the court to force Danny, Daegal and Susan to list and turn over all properties and ᴀssets held by Tony to be reviewed by the court.

Danny responded to the suit in November by filing a motion to either dismiss the sisters’ peтιтion or transfer it to surrogate’s court.

And now, Antonia and Johanna have accused Danny of taking ‘significant funds’ from the family trust — including an alleged $2.6 million in commissions — as they ask the court deny his motion, as per a January 3 legal filing obtained by PEOPLE on Wednesday.

They are said to have ‘serious concerns’ about Danny’s alleged ‘mismanagement’ as sole trustee.

‘Danny acted in multiple, conflicting fiduciary capacities for an extended period prior to Tony’s death and took (for himself and his children) significant funds from the Family Trust,’ the sisters allege in the legal docs.

‘Moreover, as publicized by Danny to various media outlets, at some point prior to Tony’s death, Tony entered a phase of diminished capacity, which means Tony was no longer able to act as co-Trustee, leaving Danny to serve as sole Trustee of the Family Trust with no oversight.’

Antonia and Johanna argue that this ‘lack of transparency’ gives them a right to see ‘an accounting of Danny’s actions both before and after Tony’s death.’

‘[Tony] expressed a clear intention and direction in his estate plans that all four of his children be treated equally,’ the court docs obtained by PEOPLE state.

Antonia and Johanna went on to detail Danny’s alleged spending of the family trust, which they say included cutting checks ‘as he saw fit.’

They claim that Danny made ‘multiple gifts to himself’ totaling $200,700 in trust funds back in 2022.

They also allege that Danny started taking monthly advances of $50,000 starting in 2021 — prior to a formal agreement that was reached in 2022.

This extra $50,000 a month was on top of the commissions Danny already earned as Tony’s manager, the filing says.

The sisters are also calling into question their brother’s claim that Tony was ‘in financial trouble’ in 2022 when he helped orchestrate the sale of the late singer’s music ᴀssets and likeness rights to Iconoclast. 

Antonia and Johanna allege that Tony ‘still had millions of dollars’ when the deal with Iconoclast was made. 

They also claim that, despite Danny’s alleged concerns for their father’s fortune, he continued ‘to make gifts to himself and his children with Family Trust ᴀssets.’

They allege that Danny has paid $2.6 million in commissions to his artist management company, RPM Productions.

Meanwhile, Johanna and Antonia claim in the legal docs that they’ve only received $245,000 each in trust funds.

‘Without more information about Tony’s income, it is unclear whether the payments Danny was making to himself exceed what was contractually owed to him,’ the legal filing explains.

‘Statements and management agreements provided by Danny indicate that commissions paid to [his company, RPM Productions] appear to have been much higher than they should have been based on Tony’s income.’ 

Johanna and Antonia have also accused Tony’s widow Susan and their brother Dae of ‘avoid[ing] accountability for Danny’s actions’ by arguing against their request to view a full accounting of Bennett’s ᴀssets before and after his 2023 death.

In their June court filing, Antonia and Johanna told the court that they are in search of ‘equitable relief’ and claim that Danny did not fully account for the totals in selling a portion of the rights to the late singer’s catalog, name, image and likeness to Iconoclast.

Danny ‘obtained personal benefits for himself and his company’ in the deals, Antonia and Johanna said in legal docs of the transactions, which also included the selling off of some of Tony’s personal belongings and memorabilia.

Danny and his lawyers ‘have persistently failed and refused’ to show the full details of the aforementioned transactions, Antonia and Johanna said in their filing, noting they have a vested interest as beneficiaries.

Attorneys for Antonia and Johanna said in their filing that Danny and his legal team ‘have provided piecemeal information and produced some documents’ in the case that fall short in clarifying the issues at hand.

‘The information provided raises more questions than answers and fails to provide anything close to an accounting of Tony’s ᴀssets and financial affairs,’ lawyers for Antonia and Johanna said in the court filing.

Antonia and Johanna said they have ‘well-founded concerns’ in regards to the totals the I Left My Heart In San Francisco performer left behind amid his death via the family trust and the company Benedetto Arts, LLC, according to legal docs.

Antonia and Johanna are requesting the court to order all holdings be ‘inventoried, accounted for, and distributed pursuant to the express terms of the family trust,’ according to legal docs.

They are asking for Danny to account for all totals with documentation in regards to taxes, disbursements and related expenses, according to court docs.

Iconoclast on March 19, 2024 announced it had acquired significant portions of Bennett’s catalog, name and likeness, though Sony Music said it remains the owner of the singer’s catalog, according to Billboard.

Other aspects of the deal included Bennett-branded endeavors such as a restaurant in New York City, a watch brand and a documentary on Paramount+ about Bennett’s work with Lady Gaga.

The company’s founder Olivier Chastan said in a statement at the time: ‘We all walk in the footsteps of giants. Tony was one of these giants.

‘Besides his extraordinary talent that radiated for over 60 years, Tony’s legacy is one of character, integrity, kindness and courage. We are truly honored to be the custodians of this incredible and historical legend.’

Danny said at the time, ‘In working with Tony for over 40 years, my philosophy was always that I didn’t manage a career but, rather, managed a legacy. Iconoclast … will continue this tradition.’

Bennett dealt with health issues in his final seven years, as he revealed to AARP in 2021 that he had been diagnosed with Alzheimer’s disease in 2016.

‘There’s a lot about him that I miss. Because he’s not the old Tony anymore … But when he sings, he’s the old Tony,’ the singer’s widow Susan told the outlet at the time.

She said the health issues had been kept quiet for years because Bennett ‘never wanted the audience to know if he had a problem’ as he liked to ‘say he’s in the business of making people feel good.’

Susan said that the Rags to Riches artist at the time was ‘not always sure where he is or what is happening around him.’
